Christopher Bannon Obtains 11th Circuit Appellate Victory

Commercial litigator Chris Bannon recently won a significant insurance coverage case in the United States Court of Appeals for the Eleventh Circuit. The appellate court ruled in favor of our client, an errors and omissions liability insurer, finding that the insurer had no duty to defend, or pay any judgment against, a Birmingham, Alabama real estate brokerage firm. The real estate firm sought coverage from the insurer for a lawsuit two former competitors brought against it, alleging several claims arising out of aborted business mergers. Although a federal district court initially determined that the insurer was required to defend the broker, the U.S. Court of Appeals reversed that ruling, finding that the claims against the broker did not result from the broker's real estate professional services.
